Autofinders Car Sales

1.1 "The company" shall mean Autofinders Limited.

1.2 "The purchaser" shall mean the person in whose name the vehicle is ordered.

1.3 "The manufacturer" shall mean the manufacturer of the respective vehicle.

1.4 "The vehicle" shall mean the motor vehicle or vehicles specified on the Order Form.

1.5 "The order" shall refer to the signed order form.

2. RATIFICATION:

2.1 The order is offered by the purchaser and is subject to acceptance and confirmation in writing by the company.

2.2 The company reserves the right to reject any offer with notice in writing and return the deposit in full.

3. REPUDIATION

3.1 If the purchaser fails to make full payment of the vehicle within 7 days of notification that payment is due, the company is at liberty to treat the contract as repudiated.

3.2 Should the contract be repudiated the deposit shall be forfeited without prejudice to the company's right to recover from the purchaser by way of damages any loss or expense which the company shall incur by reason of the purchasers default.

4. DEPOSIT:

4.1 A deposit of £500 will be paid by the purchaser on submission of the order unless otherwise agreed.

4.2 The deposit in non-refundable as detailed in clause 3.2

4.3 Any factory fitted options ordered (excluding metallic paint), will be paid by purchaser at time of order.

4.4 Payment of the deposit shall be made by credit, debit card or cheque. Please make cheques payable to Autofinders ltd.

5. CHANGES TO PRICES

5.1 Where the company agrees to deliver the vehicle otherwise than to a location chosen at the company's discretion, an additional charge will be made as is detailed on the order.

5.2 Where the purchaser chooses to amend the delivery address after the conclusion of the contract, the charge for delivery may be subject to alteration and this may incur a small administrative fee at the company's discretion.

5.3 The company reserves the right to make changes at any time, without notice, to price dependant only on any changes made by the manufacturer and importer during the model year.

6. PAYMENT OF VEHICLE

The company shall offer the purchaser three options of final payment for the vehicle:

6.1 Debit/Switch card. The purchaser may pay for the vehicle using their debit/switch card prior to delivery. There is no charge for this service

6.2 Bankers Draft. The purchaser may pay for the vehicle by Bankers draft, made payable to Vanfinders Ltd, prior to delivery.

6.3 Bank Transfer. The purchaser may pay for the vehicle by bank transfer prior to delivery. Please contact your sales executive to discuss this

7. VEHICLE REGISTRATION

7.1 Vehicles may be pre-registered.

8. CHANGES IN TAX

8.1 If after the date of this contract and before delivery to the purchaser there shall be any increase in the amount of tax payable in respect of the vehicle or any of the accessories or the sale thereof, the company shall give notice in writing and the price of the vehicle shall be increased by said amount, unless within 7 days of notice being given, the purchaser notifies the company that he declines to accept the increase in which case the company shall be under no further liability.

8.2 If after the date of this contract and before delivery to the purchaser there shall be a reduction in the amount of tax payable in respect of the vehicle or any of the accessories or the sale thereof, the company shall reduce the price of the vehicle accordingly.

9. CHANGES TO SPECIFICATIONS

9.1 If for reasons outside of the control of company, they shall be unable to supply a vehicle of the model specified both parties shall be liberated from any further obligations without liability and the deposit of the buyer shall be returned in full.

10. DELIVERY DATE

10.1 The company will endeavour to secure delivery of the goods by the estimated delivery date but does not guarantee the date of delivery and shall not be liable for any claims in respect of delay in delivery.

10.2 The estimated delivery date is not of the essence of this contract.

10.3 The company shall not be obliged to fulfil orders in the sequence that they are placed.

11. TRANSFER OF TITLE/OWNERSHIP

11.1 The vehicle to be sold by the company shall remain the property of the company until payment has been discharged in full.

11.2 Payment shall not be treated as such until cleared funds have been received.

11.3 Once title to the vehicle has been transferred to the purchaser, the company shall be under no further liability.

12. PURCHASERS RIGHTS

12.1 Nothing herein is intended to affect, nor shall affect, the purchaser's statutory rights.

13. GENERAL

13.1 The company shall not be held liable for any delay or failure in performance caused by circumstances beyond it's reasonable control.

13.2 Vehicle pictures shown on the website are for illustration display purposes and may not exactly represent the vehicle in which is being enquired.

13.3 This agreement shall be governed by and construed in accordance with the laws of England and Wales.
